Philadelphia, PA personal injury attorney Leon Aussprung M.D., ESQ. talks about the statute of limitations for filing a wrongful death case. In Pennsylvania, the statute of limitations for filing a wrongful death case is two years from the date of the individual’s death. If negligence occurred while the individual was alive, and they subsequently lived for another six months before passing due to that negligence, the statute for wrongful death begins only upon the individual’s death. From that date, there is a two-year period to file a lawsuit. A lawsuit cannot be filed more than two years after the individual’s death.
