um there are two that come up uh very
often and so I’ll focus on those but
those are temporary partial disability
and temporary total disability temporary
total is when the person’s completely
off of work uh their physician says
they’re unable to work and so the
carrier pays benefits at that point
temporary partial is the benefit that is
the most contentious and you see the
most litigation over and that’s where a
physician has assigned restrictions that
prevent the pre-injury job but the
injured worker may still not be working
or earning at least 80 percent of their
average weekly wage

He explains that there are five types of wage loss benefits, but two are more commonly used: temporary partial disability and temporary total disability. Temporary total disability is when a person is completely unable to work due to their condition as stated by their physician, and benefits are paid by the carrier. On the other hand, temporary partial disability is the most controversial benefit, and often involves litigation. It occurs when a physician places restrictions on the pre-injury job, but the injured worker is still not working or earning at least 80 percent of their average weekly wage.
