Generally, trust contests are similar to will contests in that most of them involve claims of undue influence and fraud. More often there’s going to be capacity issues in a trust because the requisite level of capacity to execute a trust is higher oftentimes than it is for a will. You also have issues of lack of due execution, you’ll have forgery, you’ll have menace, duress, and obviously, mistake, but oftentimes its undue influence and fraud.
