We don’t have as many as say the auto accident, okay that’s kind of normal with more cars out there and in terms of the city than trucks on the highways. My experience is basically is we look at the Federal Regulations as to the guidelines of that we make sure that we get their insurance. Truckers have higher Insurance amounts as well, okay. The average trucker’s liability amount is a million dollars typically, okay, for I think just liability insurance. And Missouri, let me compare that back to automobiles in Missouri, they have a minimal insurance level that’s $25,000, which is nothing if somebody gets hurt in trucking. There’s no limit as to that.

Okay, we look at the limits of liability, we look at who’s responsible, what kind of operation they were doing when the last checkup on that truck happened, when did they get it inspected, all those things. Look at the high. Whenever there’s a trucking accident, the Missouri Highway Patrol has to investigate that, okay? So we get those reports as well as the local reports as to what happened, and also the inspection report, just to make sure that these things are complied with. Often, now you gotta know what you’re looking for because sometimes the trucking company don’t want to give you certain things because they don’t want to be liable for negligent driving or some failure to maintain equipment. So we have to look and make sure that that may even require getting an expert witness to come in and evaluate that. Okay, so we’re ready to do all those things.

St. Louis, MO personal injury attorney Herman Jimerson talks about experience in Missouri truck accident cases. He explains that trucking accidents are less common than auto accidents, which is typical given the higher number of cars on the road compared to trucks. In his practice, he focuses on reviewing federal regulations and ensuring that trucking companies have adequate insurance coverage. Truckers typically have a higher insurance liability, often up to one million dollars, compared to the much lower minimum insurance level for automobiles in Missouri, which is just $25,000—far less than what is needed if someone is injured in a trucking accident.

Jimerson reviews the limits of liability and investigates the responsible parties. He examines factors like the type of operation the truck was involved in, when the truck was last inspected, and its maintenance records. In trucking accidents, the Missouri Highway Patrol is required to investigate, and Jimerson gathers both their reports and local reports to determine what happened. He also requests the inspection reports to ensure compliance with safety standards. Often, trucking companies may withhold certain documents to avoid liability for negligent driving or failure to maintain equipment. To address this, Jimerson may need to involve expert witnesses to assess the situation. He is fully prepared to handle these challenges to ensure that his clients receive the best possible representation.
