Well my experience as a prosecutor and pretty much any type of case is helpful because I know what the other side is doing. In fact, when it comes to special victims’ cases here in Delaware County, I helped create the policies. And so, when a client comes in and says well, the victim called me the other day and asked me about the sexual intercourse and all that, you know, it seemed kind of odd that she called. I know that it doesn’t seem odd at all. I know exactly what happened and that was a consensual phone intercept and that means that the prosecution was listening and recording that phone call. So quickly I’m going to ask the question is what did you say?
And then, all of a sudden you start realizing that well I didn’t think I was being recorded so I apologized and I told her I didn’t mean to do it. And now it’s a whole different case. So these are types of things that I know early on. Also, when it comes to DNA evidence and the use of DNA evidence, the use of computer evidence, what have you texted her, what did you put on social media? When did this happen? How long ago? How far? Who were witnesses? I know the questions to ask at that initial conversation with a potential client that maybe somebody who wasn’t a prosecutor doesn’t know to ask.
