Usually, the answer is no. Most cases settle without any litigation at all. And of the cases that do end up in litigation, most of those cases settle before they end up in trial. So the number of actual civil personal injury trials is going down and down. In Minnesota, every case that’s litigated is required to go through an alternative dispute resolution process. And that process settles a lot of cases, too. So most cases end up just being insurance claims that settle out of court.

Rochester, MN personal injury lawyer Paul Dahlberg discusses why most cases don’t go to trial. He explains that in the majority of situations, the answer is no. The majority of personal injury cases are resolved without the need for litigation. Even among the cases that do proceed to litigation, a significant portion of them are settled before reaching the trial stage. As a result, the number of civil personal injury trials is steadily declining.
In Minnesota, there is a mandatory alternative dispute resolution process for litigated cases. This process often leads to successful settlements, further contributing to the resolution of cases outside of the courtroom. Consequently, many cases are resolved through insurance claims and settle without the need for formal court proceedings.
