I feel like with compliance there is a lot of turnover in who handles that compliance function, the employer. For example I-9s, which have to be completed for all new hires to show they’re work authorized, and as that task or function gets handed from person to person to person, some of the nuances and just really how to do that in the correct way can get lost.
So for example the employer has to examine original documents. So a lot of times they’re just having the new hire send PDFs of their documents and that’s not good enough in the government’s eyes. Another area is the LCA public access files for H-1bs, so there is just a lot of nitty gritty where if the person currently doing the function can get just a little handholding and a little training on how it’s supposed to be done, then they’ll be able to do that the right way going forward and then that’s going give you as the employer a good track record of, you know, where all of your files are in order.
So one thing that our firm offers would be a spot check of your I-9s. So we’ll go in and get and look at a sampling and, you know, it’s very rare that you see a set of I-9s that are all done perfectly. There is usually common really mistakes or the ways they’re completed that isn’t quite right. And you can see those patterns, identify them and provide some follow up training, and then the employer knows how to do that.
