wife on a Sunday drive on a motorcycle where, unfortunately, a dog ran out into the road in front of them, caused them to spill, crash the motorcycle and it caused very serious injuries for my client who was on the back of the motorcycle. Originally, this case didn’t seem like it was gonna go anywhere because the defendant who owned the dog claimed that she had no available insurance and she had no resources or assets to pay anything.
However, through digging and through just filing the lawsuit in spite of her claims that she had no money or no resources, we were able to find a sizeable insurance policy, actually two policies. Eventually by speaking to neighbors and having our investigator first speak to the neighbors and then I went and took depositions, come to find out that this dog had a history of always running free, that the dog owners never restrained or contained the dog and the neighbors had already complained of the dog running over to their houses and in their yards and, you know, sometimes what the defendants might tell you in the beginning of the case is not exactly true once you do a little digging.
And so that case was significant to me because the injuries were so terrible for her and the consequences to her life and to her career were not good. But by sticking with it and digging and persevering through what seemed to be a case that wasn’t gonna go anywhere, she was able to recover seven figures.
