memorable cases

um but the the most satisfying

um and I could think of one in

particular when I was younger are the

cases where you have people who have

really serious injuries and the

employers want to fight them and think

that they’re going to win or sort of

Outlast you and I had a client who was

working at a supermarket in Northeast

Philadelphia he worked in the frozen

food department and he suddenly wasn’t

feeling well and as a result he went to

the doctors and it was determined

ultimately that he had a very rare blood

disorder the disorder

um was like a cancer but wasn’t a cancer

it’s the only time I’ve ever seen or

heard of it he was sent for doctors at

two of the major teaching hospitals in

the city and they ultimately told him

the only thing that’s going to impact

your condition is exposure to cold so

you can’t work in the frozen food

department anymore because obviously

you’re exposed to cold

he had a note from the doctor took it to

his employer and his employer or the

supervisor really took the note and said

I don’t care what they say either you’re

working in that department or you’re

fired

he continued to work in that department

as a result the condition

became much worse he was never able to

work again because of it the insurance

company and the employer fought us we

ultimately won in front of a judge

because even if you have a pre-existing

condition if work makes it worse work is

responsible for treat recovering your

treatment and your wage losses we fought

that case to Commonwealth Court which is

our second level appeals court we had to

go to the appeal board and then

Commonwealth Court and ultimately we got

this gentleman his benefits but it was

all because he had this extraordinarily

rare condition and his employer didn’t

care well we cared and we fought for him

it took a few years but he got every

penny he was entitled to and we were

able to get him a settlement as well

that gave him you know additional

security
