First and foremost, before you have to give that bad news, it’s important that you create a relationship; you have some rapport with the client. You, to a certain extent, need to have a foundation to be able to do that. And I think that comes with time. I think that comes with, quite frankly, right out of the gate, explain to the client, setting a table and saying, you know, we may run into situations, where I might have to give some bad news. I might have to give some good news.

Explain to the client, right out of the gate, that it’s important from the lawyer’s standpoint to be able to have candid conversations, to have difficult conversations. So the most important think I would say is setting the table. Making sure that the client knows and understands that there may be a point in time where you have to give bad news. And if the lawyer is aware of that, and if the lawyer does a good job of talking to the client and talking through those things with the client at the beginning, it makes having those difficult conversations further down in the relationship much, much, much easier.
