in mediation it’s an opportunity for the
lawyer to uh serve as an adviser to the
client and part of that is making sure
the client is aware of all the choices
and the pros and cons to each choice
that’s laid out in mediation the client
is going to make that ultimate decision
but the job of the lawyer is to make
sure that that decision is fully
informed there’s also a component in
mediation where the lawyer is going to
advocate for their client and that takes
the form of making sure to put the
client’s best arguments forward to the
mediator and helping the mediator
understand the strengths of the client’s
positions at
mediation
Portland, OR family law attorney Kaite Goss talks about the role she plays in a divorce mediation. In mediation, the lawyer’s role is to serve as an adviser, ensuring that the client is fully informed about all available options and the pros and cons of each choice presented. Although the client makes the final decision, the lawyer’s responsibility is to ensure that the decision is well-informed. Additionally, the lawyer advocates for the client by presenting their best arguments to the mediator and helping the mediator understand the strengths of the client’s position throughout the process.
