Portland, OR family law attorney Jessica Flint talks about the trends she sees in international divorce. There are several trends emerging in the area of international divorce, particularly as families become more mobile and globalization and transnational employers grow. With more individuals holding dual nationalities and being connected to multiple countries, a significant trend is the increase in disputes over jurisdiction, with parties competing to determine which forum should handle the divorce.
Another growing trend is the rise in requests for parents to relocate their children abroad. While this can be legally done with court approval, unlawful instances of international child abduction are also on the rise. Furthermore, as individuals live in more than one country, they often possess assets and real property abroad, which creates challenges in the discovery and tracing of foreign assets, obtaining foreign evidence, and valuing property and assets located in other countries.
