Well, an expungement is a remedy for someone who has either had a judicial determination in their favor, like they won their case but there’s still a criminal record out there. Or, they have gone through probation and the case has been dismissed, or enough time has elapsed so that it’s really no longer relevant but it’s giving you some trouble. You go to the court and you ask them in for a motion to remove the damaging information from your criminal record. And in the cases where I mentioned when there’s either a judicial determination in your favor or some kind of dismissal, the judge doesn’t have any discretion in that and they have to remove it from your record. And they remove it from the court record, they remove it from the Bureau of Criminal Apprehension; the sheriff; the prosecutor, anybody that’s got any record of that case, they have to remove it from their records, and destroy the record.
