So if you find yourself in a situation where you have a, I guess, an employment termination gone wrong what I really recommend and what I do with my clients is I get very quickly aggressively into the facts of what just happened. And that involves the client thoroughly to figure out not only what’s their side of the story but any other potential witnesses that they have.
And nowadays, especially in employment situations you have people sending a lot of e-mails and sending a lot of texts and there’s usually, a bunch of different employees involved. And you really need to push hard from the outset to get an understanding of what the facts are. Because if you can get a sense early on of what the fact truly are, whether they’re good for your client or whether they’re bad for your client you’re much more likely to advise them in a way to make smart decision right then and there.
If you get that decision wrong from the outset that could take you down a path of extremely drawn out, expensive litigation. And if you’re wrong, it could be really, a bad outcome for you client. But if you’re right, it also gives you an opportunity to push back aggressively from the other side’s perhaps misunderstanding or incorrect analysis from the start. So from the very, very outset get a full understanding of the facts and then be aggressive with conveying what you truly believe those facts are.
