Well the new overtime laws will have a tremendous affect. Under the old law, the salary basis test for who would be exempt started at $23,000.00 and up so employees who made that salary and met one of the other tests such as executive or professional wouldn’t be eligible for overtime. Now while the tests haven’t changed the salary levels have increased substantially now the starting level is at over $47,000.00 so many, many, many more people are eligible for overtime employers are either going to have to raise their salaries to that level or really review their and audit their positions to make sure they meet these tests. And they should be understanding that if they don’t meet these tests they’re going to face significant penalties.
