One of the biggest challenges with nursing home cases is that sometimes you don’t get all the information and the whole story in the records because you’re asking for a record from the same people who did the misconduct in the first place. And so what’s significant about those is that having access to the right experts and the right nurses and people who have nursing home experience to go in and not only look at what does the record say happened but more importantly, what does the record say didn’t happen that should have happened.

And by looking at that, for one particular case, we were able to see that this facility did not follow the standard of care and did not follow the specific care plan that this woman had. For example, in her case, she needed a two-person assist whenever she was moved out of the bed or moved back into the bed, and by them cutting corners and doing it sloppily and not using a two-person assist, she suffered injuries that ultimately shortened her life.

We were able to get to the truth by working really, really hard on that case and by hiring the right people and digging and asking the right questions at depositions, and ended up being able to come to a settlement that really, really was pleasing for my client.

Seattle, WA personal injury attorney Erica Buckley talks about her experience handling nursing home abuse/negligence cases. She explains that nursing home cases present significant challenges, particularly when seeking comprehensive information and the complete narrative from the records. It becomes a dilemma as you are requesting records from the same individuals who may have been involved in the initial misconduct. Thus, the key lies in engaging the expertise of suitable professionals, including experienced nurses and individuals well-versed in nursing home practices. Their insights are crucial in not only examining what the records document as events but, more importantly, identifying what they fail to reveal—instances where necessary actions were neglected.

In one specific case, this approach proved instrumental. Through meticulous efforts, we discovered that the facility in question deviated from the accepted standard of care and disregarded the personalized care plan designed for the resident. For instance, the resident required the assistance of two persons whenever she was moved in or out of bed. However, due to the facility’s negligence and the use of shortcuts, they failed to provide the necessary two-person assist, resulting in injuries that tragically shortened her life.

By diligently investigating the case, enlisting the expertise of the right professionals, and conducting thorough depositions with targeted questioning, we were able to unearth the truth. Subsequently, we reached a settlement that brought considerable satisfaction to my client.

This example emphasizes the importance of dedicated effort, thoroughness, and assembling a team of qualified individuals to unveil critical details that might otherwise remain concealed. Through unwavering commitment, we strive to obtain justice and secure favorable outcomes for our clients in nursing home cases.
