The remedy for an illegal stop is what’s called suppression. So if a judge finds that a person’s constitutional rights were violated, and that would include being stopped for no reason at all or for an unjustified reason, the court’s order would be an order of suppression. So the police think that they have all of this evidence of your bad behavior, but the judge can decide that the state simply isn’t going to be able to use that evidence. So by eliminating the evidence of impairment, the evidence gathered from and after the traffic stop, often times the result of that is that the charge will be dismissed.
