Generally, what a beneficiary should do if they’re in a trust or an estate dispute is they need to figure out whether or not the terms of the existing trust are in their interest and if they are happy with the existing terms. What they may want to do is defend the trust or the will. If they believe that the will or trust is executed under fraud or undue influence or there are other grounds to contest the trust, they may make a determination that is in their interest to contest the trust or the will. However, the most important thing to realize is if they do want to contest a trust or a will, they may have a very short period of time to do that and that they need to seek an attorney’s advice right away.
