If you’re questioned by law enforcement, either state or federal, ask if you’re free to leave. If so, you can leave. If you’re not free to leave, you should invoke your right to remain silent and ask for a lawyer. You should also not lie to law enforcement; if you’re going to speak, you need to speak truthfully. Stay calm, be respectful, and don’t worry about looking guilty, because it’s more important for your lawyer, for me, to keep you out of jail than worrying about how things look to law enforcement.

Palm Harbor, FL criminal defense attorney Robert D. Eckard shares his advice for people charged with a crime. He explains that if you find yourself being questioned by law enforcement, whether it’s at the state or federal level, there are important steps to follow. Firstly, inquire if you are free to leave. If you are, you may choose to leave. However, if you are not free to leave, assert your right to remain silent and request a lawyer. It is crucial not to provide false information to law enforcement. If you decide to speak, it is essential to be truthful while remaining calm and respectful. Remember, your priority should be to protect your rights and allow your lawyer, such as myself, to work towards keeping you out of jail. Therefore, focus on your legal representation rather than worrying about how your actions may appear to law enforcement.
