i represented the family
00:06
of david silva who died
00:09
as a result of being asphyxiated by
00:12
deputies from the kern county sheriff’s
00:14
office and officers from the
00:16
california highway patrol david was
00:18
asleep
00:19
in front of a hospital one night
00:23
and he was asked to move across the
00:25
street by the security guard who was
00:27
patrolling the hospital
00:29
and at that point the security card
00:31
called the police to let them know that
00:33
this man
00:34
was asleep on the street and when the
00:37
deputies and officers
00:39
showed up they aggressively woke him up
00:42
startled him and then proceeded to get
00:45
on top of him
00:46
while they had him handcuffed and in a
00:49
hobble
00:50
and applied pressure to his back for a
00:52
continuous period of time they also
00:54
put their canine dog on him and hit him
00:56
with batons
00:58
while this was all occurring and he
00:59
eventually died as a result of that
01:02
encounter
01:03
this was a tragic case and especially
01:06
tragic because
01:08
it was filmed or witnessed by folks who
01:11
were across the hospital on their cell
01:13
phone cameras
01:14
and the night of the incident deputies
01:17
from the sheriff’s office went to their
01:19
homes and confiscated the videos
01:22
the videos then went missing
01:25
and fortunately there was video from a
01:28
nearby apartment complex that showed
01:30
exactly what happened
01:32
which happened to contradict what the
01:34
officers
01:35
said in their statements after this all
01:38
occurred
01:38
so this was a really important case for
01:40
me because
01:42
we got to really obtain justice for the
01:45
family
01:46
and make sure that we made a loud and
01:48
clear statement
01:49
to the sheriff’s office and the highway
01:50
patrol that this is not the type of
01:53
policing that we want in our community
01:56
and so we believe that it has resulted
01:59
in better training
02:00
which ultimately results in more safety
02:03
for citizens of that
02:06
county
