The most common way to settle custody and parenting time issues during a divorce is actually by agreement. Most cases resolve themselves by parties being able to reach an agreement about all of the matters at issue regarding their children. There are only some times when parties need assistance or are unable to come up with an agreement, where courts have to step in and make those decisions for them. When that happens, it’s usually the result of a motion hearing or at a trial.
