Parenting time can be modified under Minnesota law by two different mechanisms. Insignificant changes to parenting time – small, little changes either shifting parent time or a small shift in time – are governed by the best interest standards, and those are the 13 best interest factors that the courts look at when they’re determining parenting time and custody in the first place. However, significant changes to parenting time are governed by the same rules that govern child custody modifications. Those require a change of circumstances, that the best interests of the child require a change, and then proof either that the parties agree to the change, that the child has become integrated into the home of the parent that’s seeking more time, or the child is endangered with the other parent.
