A few years ago, I tried a case down in San Diego involving a road that was chronically flooding. Every time there was any significant amount of rain this road would flood. And there was a history for years the country had gone back and forth with the private landowner who owned the land adjacent to the road and there was years of memos and meetings back and forth about what was going to be done. And nothing, essentially, was done so the road would continue to flood. We represented the family of a 22-year old marine who was stationed down there at Camp Pendleton who had survived a tour of duty in Iraq, she’d been in Afghanistan, and she ends up dying in San Diego County from driving down this road, encountering this flooded section of road, and then losing control of her car. That was a case the county offered us $100,000.00 right before trial. The case went to trail the jury awarded $4 million and we collected most of that. So that was certainly a nice victory.
Torrance, CA personal injury attorney Roger Booth talks about a case involving a woman who had died in a car crash because of a road that was always flooding. He explains that a few years back, I had the opportunity to handle a significant case in San Diego involving a persistently flooded road. Every time there was substantial rainfall, this particular road would become inundated with water. Over the years, there had been an ongoing dispute between the county and the private landowner who owned the adjacent land. Countless memos and meetings were held to address the issue, yet no effective action was taken, resulting in the road remaining prone to flooding.
Our firm represented the family of a 22-year-old marine who was stationed at Camp Pendleton. This brave individual had bravely served in Iraq and Afghanistan, only to tragically lose her life while driving along this flood-prone road in San Diego County. The treacherous conditions caused her to lose control of her vehicle, leading to her untimely demise.
In the face of this heart-wrenching situation, the county offered us a settlement of $100,000 just before the trial commenced. However, we believed in the justice of our cause and proceeded to court. The jury recognized the magnitude of the negligence involved and awarded a remarkable $4 million in damages. We were able to successfully collect the majority of this compensation, securing a significant victory for our clients.
This case stands as a testament to our unwavering commitment to pursuing justice for those who have suffered unjustly. We tirelessly advocate for our clients’ rights and diligently work to hold responsible parties accountable for their actions.
